What is the UU PDP and how does it affect AI?
Short answer: UU PDP is Indonesia's personal data protection law (Undang-Undang No. 27 Tahun 2022). For AI systems, it requires explicit consent before personal data is used for training, mandates data-localization for sensitive categories, and imposes breach-notification duties. Non-compliance can result in fines up to Rp 5 billion.
UU PDP (Undang-Undang Pelindungan Data Pribadi) is Indonesia's primary data protection law, signed in October 2022 and entering full enforcement in October 2024. It is modeled on GDPR but adapted for Indonesian legal and cultural context.
For AI systems, UU PDP has three direct implications. First, explicit consent is required before personal data is used to train or fine-tune a model. Second, data localization rules apply to sensitive personal data (health, biometrics, children's data) — it must stay within Indonesian jurisdiction or with certified overseas providers. Third, breach notification must occur within 72 hours to both the regulator (Kemenkomdigi) and affected users.
The penalties are significant. Administrative fines can reach Rp 5 billion (~USD 320,000) for serious violations. Criminal penalties apply for willful misuse, with sentences up to 7 years.
